Article 1: Preamble

Article 2: Application

These general conditions apply to all sales of products presented on the ulm-dieppe.com website. Any order placed with the company LES AILES D'ALBÂTRE therefore entails the unreserved acceptance of these conditions. Only the purchaser can take advantage of these presents. These general conditions may be modified at any time and without notice by the company LES AILES D'ALBÂTRE, the modifications then being applicable only to orders made after their date of implementation. These general conditions of sale are permanently accessible via the ulm-dieppe.com site in computer formats allowing them to be printed and/or downloaded, so that the consumer can proceed to their reproduction or to save them.

Article 3: Rates

The prices are those in effect when the order is placed and include VAT and air transport liability insurance. Our rates do not include travel costs outside the coverage area.

Any price changes during the year only concern reservations made after said price changes.

The date reservation is made with Philippe Gallot on 06 21 74 64 02, or directly at the premises of Les Ailes d'Albâtre at the Dieppe aerodrome.

Article 4: Payment

The consumer expressly declares that he has all the necessary authorizations for the purposes of using the method of payment he has chosen during the validation of his order. He also undertakes to ensure his solvency before any order, fault for the company LES AILES D'ALBÂTRE to be able to deliver the ordered products. The company LES AILES D'ALBÂTRE also reserves the possibility of suspending or canceling any order or delivery in the event of refusal to issue payment authorization by the financial organizations questioned according to the method of payment chosen by the consumer. Likewise, it reserves the right to refuse to take into account an order or to make a delivery from a consumer with whom a dispute relating in particular to the payment of a previous order remains. The consumer is also advised that the company LES AILES D'ALBÂTRE may analyze and/or verify orders placed in order to fight against fraud, and in this context reserves the right to ask the consumer any supporting documents that it deems useful. 4.1: Payment with Paypal

4.2: Payment by credit card

In the event that the consumer opts for payment by credit card, he will be directed to the Paypal secure server, which will offer him the possibility of paying via a credit card or via his Paypal account if he has one. The consumer's bank details are therefore never in the possession of the company LES AILES D'ALBÂTRE; their conservation and the maintenance of their integrity are therefore the responsibility of the banking establishment.

The "3D Secure" authentication procedure (also called "Verified by Visa" and "MasterCard SecureCode"), which guarantees optimal security during online purchases by verifying the identity of the card user, can be activated. The authentication methods are specific to each bank: you may be asked to enter personal data (such as a date of birth) or to enter a code received by SMS or even to answer a personal question.

Once the payment has been validated by the consumer on the bank's secure server, he has the option of returning to the ulm-dieppe.com site.

4.3: Payment by check

Only checks from a French bank are accepted. This method of payment is only open to consumers with a delivery address in France and for orders of less than 100 euros including tax.

A payment in several checks is not possible.

4.4: Payment by bank transfer

The consumer must ensure that he bears the transfer costs levied by his bank. The company LES AILES D'ALBÂTRE must collect the net amount of the order.

Article 5: Delivery and Information

The products are delivered to the delivery address provided by the consumer when ordering. You can choose to have the voucher sent by email or post.

In the event that the delivery address is different from the billing address, the consumer should provide these two separate addresses in the order form. Only the delivery address determines the application or not of French VAT or the country of delivery (if applicable), or customs duties.

Article 6: Returns / Right of withdrawal

The legislation on distance selling is governed by the Chatel and Hamon law of June 2014. As such, article L. 221-28 of the Consumer Code provides: "The right of withdrawal cannot be exercised for contracts :

12° – Provision of accommodation services, other than residential accommodation, goods transport services, car rentals, catering or leisure activities which must be provided on a date or at a specific period .

Consequently, no right of withdrawal is applicable to our ULM transport and leisure ticketing. Gift vouchers purchased on the ULM-Dieppe.com site are valid for 2 years, the beneficiary must transform it into a ticket with appointment before this deadline.

Ultralight flying is totally dependent on the weather. Only our pilots are authorized to make the decision to take off or land prematurely. Les Ailes d’Albâtre reserves the right to cancel a flight due to bad weather conditions, at any time and until take-off, for safety reasons. Les Ailes d’Albâtre will not be liable for any costs incurred by customers in the event of cancellation.

The voucher is valid for two years from the date of issue. After booking a date, if your flight is canceled due to weather conditions, you must book a new flight date with us within the validity period of your ticket. If this cancellation occurs 4 times within the two years of validity, your ticket will be renewed for 12 months free of charge, on request by email. This free extension of 12 months must be the subject of 3 reservations before the end of validity to obtain another extension.

Without having made your minimum 4 flight attempts during the two years, the ticket will be considered consumed or may be renewed for 1 year with an additional €50 per person. This paid 1-year extension will be accepted within 2 months of the end of validity.

In the event of cancellation by the customer within 8 days before the scheduled date of the flight, if the passengers are not present on the day of the flight or if the customer refuses the place and time of the flight, the ticket will be considered consumed.

In the event of a temporary or permanent impossibility of the passenger for the realization of his flight service, because of a medical problem, pregnant woman or other personal problem... the said flight ticket will keep its initial validity without taking into account a free extension or a refund.

In the event of a complaint, this must be made within a reasonable time following the said dispute and upon sending a letter, necessarily accompanied by a copy of your flight ticket.

Any complaint not made in the rules defined above and within the time limits cannot be taken into account and will release the seller from any liability vis-à-vis the buyer without mandatory return correspondence on the part of the seller.

Article 7: Personal data

In accordance with the law of January 6, 1978 amended by the law of August 6, 2004, Internet users have the right to access and rectify personal data concerning them. These data are provided only for the purpose of delivering the products ordered through the site, by email or post. They are mandatory for the processing of the order and any checks carried out to fight against fraud. If optional data were to be collected, the consumer would be informed of this optional nature. The consumer is advised that the refusal to provide mandatory data results in the impossibility of delivering the products he wishes to order.

All requests for clarification concerning the personal data and/or the purpose of the processing implemented, as well as the exercise of the rights of access, rectification and opposition will be made from the "contact" page of the site.

Boarding :

No one has the right to board the ULM without having a valid flight ticket. As a passenger air carrier, LES AILES D'ALBÂTRE is subject to the conditions stipulated in the Warsaw Convention. The pilots are the only masters on board and as such they have authority over all the people on board. They have the right to refuse boarding or disembark any person among the passengers who may present a danger to the safety, health or good order of the aircraft.

LES AILES D'ALBÂTRE reserves the right not to board a passenger until the last moment of the flight and does not undertake to reimburse the flight ticket.

The captain reserves the right to refuse boarding of a passenger if he considers that the latter is not fit to practice his flight in a microlight: all passengers must be able to get on and off the microlight. by its own means. The pilot is in no way responsible for medical problems that have been hidden by the passenger for the sole purpose of being able to carry out his flight despite everything.

In the case of a delay at the appointment beyond the call of the passengers, the late customer's ticket will be considered as consumed.

Flight conditions:

The flight being entirely subject to the weather and the geographical constraints of each flight sector, we cannot guarantee with certainty any circuit or route or flight duration. The estimated duration of the flight is indicated on your ticket. The pilot will make his best efforts to respect this duration. However, the Buyer is informed and accepts that this duration is an estimate that may vary depending on the flight conditions and the choices of the pilot in flight dictated by the safety of the said flight.

Cancelation:

LES AILES D'ALBÂTRE reserves the right to cancel a flight due to:

– bad weather conditions or for safety reasons. This cancellation can occur just before take-off. In this case, Les Ailes d’Albâtre is in no way held responsible for the expenses incurred by the passenger to get to the meeting place (travel, accommodation, catering). This cancellation can take place up to the day of the flight.

– in the event of very high heat or a heatwave alert.

– the unavailability of the pilot of the flight whatever the reasons: temporary or permanent physical incapacity (illness, accident) and personal unavailability (death in his entourage…): non-exhaustive examples

In any case, the ticket remains valid until the end of its period of validity. The passenger will have to book again before the end of its validity.

Insurance:

Insurance costs covering each passenger under civil liability related to the aircraft used are included. Risks are covered for amounts comparable to those required by the Warsaw Convention, in terms of air passenger transport. Items taken by passengers are not taken into account by our insurers, nor are any damage caused to your clothing or in the event of suicide or self-injury. It is your responsibility to take out additional insurance if you deem it necessary.

If you want a refundable ticket, you must subscribe to it only when you purchase and not afterwards.

Medical conditions:

We are not qualified to judge your good physical condition for a flight, it is up to you to take advice from whom it may concern. You cannot fly if you suffer from a serious medical problem (broken or convalescent limb, chronic back pain, cervical, hips, knees, ankles…) or if you have just undergone a surgical operation without a medical certificate attesting to your good health.

We are sorry that we cannot board pregnant women or anyone under the influence of drugs or alcohol.

In the event of a temporary or permanent impossibility of the passenger for the realization of his flight service, because of a medical problem, pregnant woman or other personal problem... the said flight ticket will keep its initial validity without taking into account a free extension or a refund.

All our passengers must be able to get on and off our microlights without outside help.

Children: We do not accept to fly children under 5 years old as well as passengers weighing more than 120 kg. It is your responsibility to inform us of the exact age of the child.

Mediation

In accordance with article L. 616-1 of the Consumer Code, in the event of failure of the complaint made to our services, the Buyer may submit the dispute between him and the Seller by resorting to the mediation service which will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution.
